THESE
TERMS AND CONDITIONS
These Terms
and Conditions apply to all transactions on this website and over
the telephone. Please read them carefully. They do not affect your
statutory rights.
We may change
these terms and conditions at any time. Any changes will take
effect on the date they are posted onto the site. Upon placing
any order you will be asked to read and accept the terms and
conditions.
ORDER
PROCESS
You will have
an opportunity to check and correct any input errors in your
order up until you click the Submit Order button.
After you
submit an order we will give you an Order Reference Number and
details of the products you have ordered which will include
the part numbers, description and full price breakdown. We will send the
same details to you in an e-mail (our first e-mail). We will
then send a second email upon starting to process your order,
which will confirm your order and confirm if payment has been
successful. Our third email to you will contain details of how we
will deliver your product/s to you. (Alternatively, we may
decline all or part of your order for any reason, in which
case we will tell you in this email.) Acceptance of your order
and the creation of a legally binding contract between us will
only occur when this second email is sent to you.
We will
notify you by email and/or phone if your payment details
cannot be authorised for any reason and may invite you to pay
by another method.
Please note,
in some cases we may use your details in conjunction with
credit reference agency checks with Experian Limited or other
agencies. In particular, we may pass your details to Experian
for them to check against certain public and private
databases. Experian may keep a record to use in future
security checks. This helps to protect you and us against
fraudulent transactions.
PRICES AND PAYMENT
All prices
and charges on this site are in UK sterling pounds (GBP - £).
Prices exclude delivery charges unless
stated on the listing P&P included or postage included.
The total
cost of your order will be the price of the products you
order, any additional services you choose (e.g. installation),
plus any applicable delivery charge. All these will be set out
clearly in your Shopping Basket before you submit your order
for you to review.
Prices,
offers and products are subject to availability and may change
before (but not after) we accept your order. If something
becomes unavailable we may offer you an alternative or
cancellation or inform you about the waiting period, also
known as backorder.
Payments: We
accept MasterCard, Visa, Visa Electron, Delta, Maestro, Switch
and Solo. Payment is deducted when we process your order.
In addition we also accept cheques (clearance is required
prior to postage/delivery). We also accept payments by direct
bank transfer, postal
orders, PayPal or cash. For Collections we also accept payment by
cash, payment will be taken when you collect the goods, in the
case of a special order for collection we may ask you to pay
for the goods up front or a deposit.
DELIVERY
Delivery may be to a address in the United Kingdom or anywhere
worldwide. All deliveries must be
signed for (except items sent by post and which are small
enough to be put through your letterbox, i.e. a letter). We also
deliver
internationally, again large items will be signed-for items
which ensures a safe delivery.
Delivery Charges: We make
every effort to keep our delivery charges as low as possible.
Our charge depends on the value of your order and on whether
you choose a different class of delivery. When you add
products to your Delivery Shopping Basket, the appropriate
delivery charge will be added automatically. There are
additional charges if you choose a different delivery service
(e.g. a faster service). If you add additional items, please
double check the charge by clicking “Re-calculate”. You
will always be able to see all applicable charges before
submitting your order.
For some international
destinations there are times when the cart system will not be
able to calculate accurate shipping costs and a small surcharge
may apply. We will contact you and let you know about this
change.
We will notify you which
delivery method we will use when we send you our third e-mail
after the purchase. Very occasionally different products in the same order
may be delivered separately, we will inform you about this via
email.
Please note: Delivery times
are calculated in working days - i.e. Monday to Friday
inclusive (but excluding bank holidays). If you order after 4.00pm, please calculate your delivery time as if your order
had been placed the following working day.
Important: We do everything
we can to meet the delivery times specified in this section.
However, occasionally delivery times may be affected by
factors beyond our control and therefore they cannot be
guaranteed. We will inform you if we become aware of an
unexpected delay.

MISSING, DAMAGED OR
INCORRECT ORDERS
We try very hard to ensure that you receive your order in
new/excellent condition. If you do not receive all your
products, please contact us ASAP (contact
page). In the unlikely event that a
product arrives damaged or faulty, please contact us within 48
hours.
COLLECTION
Collection is possible by
appointment only, please contact
us for more details.
CANCELLATIONS
- NEW ITEMS ONLY (Delivery items only)
For online sales the following
regulations give consumers an
unconditional right to cancel the order during a 7 day
"cooling off period". The cooling off period begins as
soon as the order has been placed.
If you wish to cancel your
order you must contact us using one of the methods below:
- emailing us at returns@emotouk.com
- phoning us by using the
contact tab at the top of the page
- you must inform us of your
final decision by writing, fax or email
Providing that the cancellation
is made within the
"cooling off period"
you will receive a full
refund, and the cancellation is free of charge.
In the event that the
cancellation is made after the
"cooling off period"
you may incur a small handling & re-stocking charge we will
notify you about this prior to the refund taking place.
Alternatively we can offer you an in-store credit.
Special order items (items
which have to be made to order) cannot usually be cancelled, if
you contact us we will however consider canceling the order and
providing a refund or in-store credit, we reserve the right to
charge you a handling & re-stocking charge.
Our accounts department will reimburse the
price of the goods within 30 days from the date you notify us of
the cancellation of your order or a certain product from your
order.
RETURNS - NEW ITEMS ONLY (Delivery items only)
For returns once you have
received the product/s or order you must contact
us for us to issue you with a returns number (RMI)
within 7 days of you recieving the order. Your return item/s must be received within 14
days back to our warehouse after you have received the RMI
number. We may accept returns for items not required after 7
days but at our discretion and less than 100% credit value,
you must contact
us for all returns.
Your product/s must be
complete, unused and in 'as new' condition (e.g. if
you have opened the box to examine the product you must have
done so without damaging or marking the product in any). It
should be returned with the original box, packing and
accessories. Any 'Free Gifts' received with
the product must also be returned.
You will receive a full refund
for the item/s, and the cancellation is free of charge you must bear
the costs for the return postage, which must be recorded
signed for and insured.
Our accounts department will reimburse the
price of the goods within 30 days from the date you notify us of
the cancellation once the goods have been received at our
offices.
We cannot cancel your
purchase when:
- there is a contract for
services with the product and you have started using the
services.
- the seal has been broken
on any sealed product; or
- the goods were a special
order to your specification and made to order.
- business to business sales
i.e. if you are purchasing on behalf of a business and are
being billed to your business.
- the goods are used.

We try very
hard to ensure that all information on this site is accurate.
However, just occasionally, an error may occur. If we discover
an error in the price or description of a product you have
ordered, we will tell you and ask you whether you wish to
continue with your order or cancel it.
GENERAL
These terms
and conditions and all transactions relating to this website
are governed by English law and are subject to the
non-exclusive jurisdiction of the English courts. We do not
accept amendments to these terms and conditions. |
